GENERAL TERMS AND CONDITIONS

FESTIVAL ACCREDITATIONS

These general terms and conditions (“Terms”) govern the rights and obligations of the contracting parties, namely FILM SERVIS FESTIVAL KARLOVY VARY, a.s., Company ID: 256 94 545, with its registered office at Panská 892/1, 110 00 Prague 1 - Nové Město, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. B 5552 (“Organizer” or simply “we”), as the organizer of the social and cultural event called the Karlovy Vary International Film Festival (“KVIFF”), and you as the visitors of KVIFF (“you”), and specify the conditions for obtaining and purchasing festival accreditations and their use within KVIFF.

The term Terms also includes the Visitor Rules and Complaints Policy, which can be found at www.kviff.com.

The Organizer is the data controller of personal data processed in connection with your visit to KVIFF and, in particular, with the application process for a festival accreditation. All information regarding the processing of your personal data is contained in the Privacy Policy, available at www.kviff.com/cs/ochrana-osobnich-udaju.

The website is operated by the Organizer. More at www.kviff.com.

I. FESTIVAL ACCREDITATIONS

Festival accreditations and tickets can be purchased in the manner described below. Detailed information about prices, sales start date, and box office opening hours for the given edition is published on the website www.kviff.com.

Please act in accordance with these Terms, the Organizer’s instructions, applicable laws, and principles of good conduct. We are entitled to suspend the issuance or validity of a festival accreditation at any time if these Terms, the Organizer’s instructions, applicable laws, or principles of good conduct are violated. Festival accreditation is non-transferable and you are solely responsible for its use. In the event of any misuse of the accreditation or ticket, the Organizer has the right to invalidate, revoke it, or deny entry to the respective event.

1. Individual Tickets

An individual ticket for a selected film can only be purchased on-site in Karlovy Vary. Ticket sales are available exclusively at the box offices in the Thermal Hotel.

2. Festival Pass Accreditation

The Festival Pass accreditation is intended for visitors under the conditions specified below for the entire duration of the festival. It allows you to obtain up to 3 tickets per day for 3 different films free of charge, via the Vodafone KVIFF Guide app. The use of the Vodafone KVIFF Guide app is governed by separate terms, which are available primarily within the app.

The Festival Pass accreditation also grants access to press conferences at the Thermal Hotel if there are unoccupied seats (priority is given to accredited journalists) and entry to KVIFF Talks with actors, directors, and other filmmakers.

With a Festival Pass, you can also attend film screenings without a ticket, as five minutes before the start of a film, any empty seats may be taken. Admission is on a first-come, first-served basis, and seating is not guaranteed.

You are also entitled to free use of the festival buses and Specialized festival bicycles.

3. Festival Pass + Accreditation

The Festival Pass + accreditation offers the possibility to reserve tickets before arriving at KVIFF through a registered user account in the Vodafone KVIFF Guide mobile app. The accreditation is sold online at www.kviff.com, and its issuance is subject to completing an application and its approval by the Organizer. However, the number of Festival Pass + accreditations is limited, with only 1,000 available per KVIFF edition. You must first fill out the Festival Pass + accreditation application in your user account on www.kviff.com (more details below). There is no legal entitlement to receive a Festival Pass + accreditation. The Organizer reserves the right to reject an application at its own discretion, i.e., we reserve the right to individual consideration. After receiving the application, the Organizer will evaluate whether or not to issue the Festival Pass + accreditation based on its own profiling criteria. If your application is approved, you will receive a link for online payment. Before payment, you can enter billing information and request an invoice. Once the payment is successfully completed, your Festival Pass + accreditation will be assigned. The Festival Pass + accreditation is non-transferable. The Festival Pass + accreditation can be purchased individually (1+0) or for yourself and one additional visitor (1+1).

With the Festival Pass + accreditation, you will also receive a discount voucher for kviff.tv (in the form of a discount code in your user account at www.kviff.com) and a discount on KVIFF-branded merchandise in festival shops (in the form of a discount code in your user account at www.kviff.com).

In addition, the Festival Pass + accreditation includes all the benefits of the standard Festival Pass: the ability to reserve up to 3 tickets daily for 3 different films free of charge, access to press conferences at the Thermal Hotel if seats are available (priority is given to accredited journalists), access to KVIFF Talks with actors, directors, and other filmmakers, entry to films without a ticket—five minutes before the screening starts, empty seats may be taken on a first-come, first-served basis (seats are not guaranteed), and free use of festival buses and Specialized festival bicycles.

4. Press Accreditation

Press Accreditation is a journalistic accreditation intended for journalists from all types of media (print, online, television, radio, photography), PR agents, and individual content creators on social media platforms. Applicants for Press Accreditation must apply by the deadline published on the website www.kviff.com.

Press Accreditation provides access to the full range of services offered by the press department. In addition to free access to press screenings, the holder of this accreditation may also collect up to 3 tickets per day for public film screenings.

5. Press Light Accreditation

Press Light Accreditation is a limited version of the Press Accreditation and provides access to the full range of services offered by the press department. However, film viewings are only possible through press screenings or access to the video library. Press Light Accreditation does not allow for collecting tickets to public film screenings (this type of accreditation is suitable for photographers, camera operators, or journalists who only need access to press screenings).

6. Shared Terms for Press and Press Light Accreditations

What do you get with Press and Press Light Accreditation?

  • Exclusive to Press Accreditation: 3 tickets per day for public film screenings, with the option to reserve tickets via the KVIFF Vodafone Guide app.
  • Free access to Press & Industry screenings.
  • Online video library.
  • Press Office and Press Center Services – information for journalists, facilitation of interviews with filmmakers and festival guests, access to press conferences and KVIFF Talks, entry to special festival areas (Press Lounge, Meeting Point…), updates on press events, technical facilities for journalists, and press kit distribution.   • Photographs and videos in high resolution.
  • Materials: press releases, program brochure, , film press kits, online festival catalogue.
  • Information service through Dailies – a daily event and activity plan for journalists. Accredited journalists will receive it by email every evening with information for the following day. You can also subscribe to the KVIFF Daily Buzz newsletter or activate the SMS service for real-time updates on arrivals of film stars, press screening changes, press conference schedules, side events, etc.

Who are Press and Press Light Accreditations for?

  • Press Accreditation for CZK 3000 is suitable for publishing journalists, TV and radio reporters, online editors, news agency correspondents, PR agents for films screened at the festival, and content creators on social media.
  • Press Light Accreditation for CZK 2000 is primarily intended for photographers, TV crews, radio crews, and online crews who are not expected to need access to public screenings (only Press Accreditation allows collection of 3 tickets per day).
  • Each journalist can choose the accreditation type that suits them – a photographer may opt for full Press Accreditation, while a writer may select the lighter Press Light version.
  • Applications for Press and Press Light Accreditation close on June 7, 2024. After this date, applications will no longer be accepted, not even during the festival in Karlovy Vary.

Notice:

  • Accreditation is not automatically granted based on participation in previous years.
  • The festival reserves the right to reject any application. Applicants will be informed in a timely manner if their request is denied.
  • Accreditations are non-transferable.
  • In case of loss, a duplicate accreditation will be issued for a fee of CZK 200.

Conditions for Obtaining Press Accreditation

All required documents must be uploaded directly into the accreditation form. A press card alone does not fulfill the conditions listed below.

  • Print Journalist

    • Official application signed and stamped by the editor-in-chief, including a brief description of the intended work at KVIFF
    • If accredited last year, copies of published articles covering the previous edition
    • If not accredited last year, at least three recently published articles on cinema, culture, or society
    • If not accredited since 2010, one photo in .jpg format
    • Accreditation fee paid on-site or via invoice
  • TV Reporter or Crew

    • Official application signed by the program editor-in-chief or station director with stamp, including a brief description of intended coverage (for crews – list of names and roles)
    • If accredited last year, broadcast recordings from the previous edition
    • If not accredited last year, samples of recent work related to film, culture, or society
    • If not accredited since 2010, one photo in .jpg format (for crews – of all members)
    • Accreditation fee paid on-site or via invoice
  • Radio Reporter or Crew

    • Official application signed and stamped by the program editor-in-chief or station director, with a brief description of the station, program, and intended coverage
    • If accredited last year, samples of last year’s festival coverage
    • If not accredited last year, samples of recent work on film, culture, or society
    • If not accredited since 2010, one photo in .jpg format (for crews – of all members)
    • Accreditation fee paid on-site or via invoice
  • Online Journalist or Crew

    • Official application signed and stamped by the editor-in-chief, including a brief description of intended coverage
    • If accredited last year, copies of articles on last year's festival
    • If not accredited last year, three recent online articles on film, culture, or society, including URLs
    • Current website traffic statistics from an official, publicly verifiable source
    • If not accredited since 2010, one photo in .jpg format (for crews – of all members)
    • Accreditation fee paid on-site or via invoice
  • Photographer

    • Official application signed and stamped by the editor-in-chief
    • If accredited last year, published photos from last year's festival
    • If not accredited last year, published photos from recent cultural or film events
    • If not accredited since 2010, one photo in .jpg format
    • Accreditation fee paid on-site or via invoice
  • News Agency Correspondent or Photographer

    • Official application signed and stamped by the agency editor-in-chief, with a description of intended festival coverage
    • If accredited last year, copies of articles or photos from the previous edition
    • If not accredited last year, three recently published articles or photos on film, culture, or society
    • If not accredited since 2010, one photo in .jpg format
    • Accreditation fee paid on-site or via invoice
  • Freelance Journalist or Photographer

    • Email a list of media outlets you work with to [email protected]
    • Official application signed and stamped by the editor-in-chief of the main outlet for which you’ll be covering the festival, including a brief description of your planned work
    • If accredited last year, copies of your published articles or photos from last year’s festival
    • If not accredited last year, at least three published articles or photos on film, culture, or society
    • If not accredited since 2010, one photo in .jpg format
    • Accreditation fee paid on-site or via invoice

7. Industry Accreditation

Industry Accreditation is intended exclusively for film professionals actively working in the film industry: buyers, distributors, representatives of film festivals and institutions, investors, producers, and sales agents. This activity can be demonstrated, for example, by a link to the relevant website of the represented company.

Applications for Industry Accreditation can be submitted within the dates listed on the website www.kviff.com.

Industry Accreditation – allows you to make full use of the Industry Department’s services, including the option to collect up to 3 tickets per day for 3 different festival films.

8. Industry Light Accreditation

Industry Light Accreditation is a limited version that only allows access to Press & Industry screenings. It is particularly suitable for visitors who want to participate in events during Industry Days (more information will be available when accreditations open). Collecting 3 tickets per day for 3 different festival films is not possible with this type of accreditation.

9. Shared Terms and Conditions for Industry and Industry Light Accreditation

What do you get with Industry and Industry Light Accreditation?

  • 3 tickets per day for 3 different festival films, ticket reservation via the KVIFF Vodafone Guide app (only for holders of Industry Accreditation).
  • Free access to Press & Industry screenings, festival venues marked as Industry, and press conferences (unless the hall is fully occupied by Press accreditation holders).
  • Catalogue, program brochure, Press & Industry screenings schedule, and a bag with festival materials.
  • Access to the online Film Industry Guide with contacts for all film professionals attending the festival and other informational materials.
  • Who is Industry and Industry Light Accreditation intended for?
  • Industry and Industry Light Accreditation is intended exclusively for film professionals actively working in the film industry: buyers, distributors, representatives of film festivals and institutions, investors, producers, and sales agents.
  • Only individuals directly and currently involved in film preparation – filming, production, or distribution – are eligible. This can be verified, for example, with a link to the relevant website of the represented company.
  • Applicants who are not affiliated with any film company must attach a professional CV, information on their current activities in the film industry, and a plan for how they intend to use the Industry Accreditation at the festival.
  • Where and when can I pick up Industry or Industry Light Accreditation?
  • Both types of accreditation can be collected in person at the accreditation hall on the ground floor of the Thermal Hotel at the Industry counter (daily from 8:00 to 22:00, on July 6 from 8:00 to 18:00), unless otherwise stated on www.kviff.com.
  • You will receive your accreditation upon presenting proof of payment. The fee can be paid in cash or by card directly at the accreditation hall of the Thermal Hotel at the Cash Desk. If you wish to pay by invoice, please send your billing details to [email protected].

    Important Notice:
  • Being accredited at the festival in previous years does not automatically guarantee accreditation this year.
  • Industry Accreditation is granted to a maximum of two representatives from the same company.
  • The festival reserves the right to deny accreditation. In case of denial, you will be informed in due time.
  • The organizer may request additional information from the applicant regarding their professional activity in the film industry and their intended use of Industry Accreditation at the festival.
  • Accreditation is non-transferable.
  • In case of loss, a replacement fee of CZK 200 will be charged for issuing a duplicate.

II. REGISTRATION

Registration refers to the creation of a user account on www.kviff.com based on the information you provide. You can register by submitting the registration form on www.kviff.com. To create a user account and log in later, you must use ARTS ID, which is governed by the ARTS ID Terms of Use available here: https://id.kviff.com/podminky-pouzivani/obchodni-podminky-arts-id.pdf, including the ARTS ID privacy policy.

To register and create a user account, all fields must be filled out. When registering a user account, you are required to enter all information correctly and truthfully, and update it in case of any changes. After completing registration, as a registered visitor, you can apply for festival accreditation. Without registration and the creation of a user account, it will not be possible to apply for festival accreditation.

Access to the user account is secured with a username and password. You are responsible for keeping these login credentials confidential and not sharing them with anyone. In the event of misuse, we bear no responsibility.

The user account is personal, and you are therefore not authorized to allow third parties to use it.

The user account may not be available continuously, especially due to necessary maintenance of hardware and software systems.

III. CONTRACT CONCLUSION

In the user account on www.kviff.com, applicants for festival accreditation must fill out and submit an application via the online form. Based on the evaluation of the application by the KVIFF Organizer, your application may either be approved or rejected without entitlement to festival accreditation.

The contract refers to a legal act, an agreement between the visitor (applicant) and the Organizer, the validity of which is conditional upon the Organizer's approval of the applicant’s request for festival accreditation. The contract is concluded upon confirmation of the application approval by the Organizer at the moment the payment is credited, in accordance with Article IV below. Based on the contract, and provided the payment is duly made in accordance with Article IV of these Terms, you will receive an active festival accreditation.

The sale of festival accreditation and tickets is considered a leisure-time contract to be fulfilled within a specific period, and therefore the consumer cannot withdraw from the contract under § 1837 letter j) of Act No. 89/2012 Coll., the Civil Code, as amended. Tickets or festival accreditation cannot be returned without a reason; tickets can only be claimed in cases specified in the Complaints Policy. Otherwise, the Visitor Rules and Complaints Policy apply: www.kviff.com/cs/reklamacni-rad.

The contract is concluded for no longer than the duration of the relevant KVIFF edition.

The contract is concluded remotely via the web interface www.kviff.com, and you bear the costs of using remote communication tools, particularly the costs of internet access. By registering, you agree to our use of such remote communication tools.

IV. PRICE

Price refers to the payment for tickets or festival accreditation, or for other services or goods. Detailed and up-to-date information about prices, the start date of sales, and the opening hours of ticket offices is published on the website www.kviff.com.

VAT refers to value-added tax in accordance with applicable legal regulations and is already included in the price. In the event of any tax increase, the Organizer reserves the right to add the appropriate VAT or other applicable taxes to the price.

Invoice as a tax document issued in accordance with legal regulations and possibly with the VAT Act will be sent upon your request together with the payment notice. The invoice will be issued electronically based on your request after all invoicing details are filled in and will be sent to your email address.

Payment means the settlement of the price in cash at the ticket counter at Hotel Thermal in Karlovy Vary or online via a payment gateway operated by a third party without a contractual agreement with the Organizer. In the case of online payment, the payment is deemed received once it is credited to the Organizer’s account.

You will be required to make the payment before collecting your tickets or festival accreditation either in cash at the ticket counters or by card online. In such cases, the payment is made via the Comgate, a.s. payment gateway, https://www.comgate.cz/cz/platebni-brana. In the case of online card payment, the amount is due by the end of the next business day.

Payments through the payment gateway are governed by terms available at: https://www.comgate.cz/files/obchodni-podminky-2021.pdf. If payment is not made in the correct amount within the specified time limits, the contract is void from the beginning.

V. DELIVERY OF TICKETS AND FESTIVAL ACCREDITATION

Tickets and festival accreditation will be made available via the Vodafone KVIFF Guide mobile application or at the ticket counters in Hotel Thermal in Karlovy Vary.

Cashiers or staff are always entitled to check the validity of the festival accreditation and ticket reservations. Without valid festival accreditation for the person registered in the user account, you will not be granted entry to any film or other KVIFF event.

VI. COMPLAINTS

Complaints are governed by the Complaints Policy, available at www.kviff.com/cs/reklamacni-rad.

You will be informed of the resolution of your complaint via email.

VII. WITHDRAWAL FROM THE CONTRACT

Withdrawal from the contract, i.e. termination of the contractual relationship, may occur for the reasons and in the manner stated in this article, in other provisions of the Terms and Conditions, or in cases stipulated by law.

You explicitly agree that the contract will be fulfilled and services will begin to be provided to you upon the issuance of festival accreditation or tickets.

The Organizer is entitled to withdraw from the contract at any time before providing you with any service if there are objective reasons why the service cannot be delivered. We may also withdraw from the contract if it is evident that your user account contains false, impossible, unlawful, or defamatory information or requests. Furthermore, we may withdraw from the contract if you repeatedly or seriously violate these Terms and Conditions, or if you use the services in a manner contrary to them.

VIII. DISPUTE RESOLUTION (WITH CONSUMERS)

We handle consumer complaints via the email address [email protected]. Information regarding the resolution of a complaint will be sent to your email address.

In the event of a consumer dispute arising from a contract between the Organizer and the consumer, which cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court dispute resolution to the designated body for out-of-court resolution of consumer disputes, which is the Czech Trade Inspection Authority, with its registered office at Štěpánská 796/44, 110 00 Prague 1, Company ID: 000 20 869, website: www.coi.cz. Consumers may also use the online dispute resolution platform established by the European Commission at http://ec.europa.eu/consumers/odr/.

The supervisory authorities overseeing our activities, to which you may turn in case of complaints, include: for consumer protection – the Czech Trade Inspection Authority, based at Gorazdova 1969/24, 120 00 Prague 2, www.coi.cz; for trade licensing control – the competent trade licensing office; and for supervision of personal data protection – the Office for Personal Data Protection, located at Pplk. Sochora 727/27, 170 00 Prague, www.uoou.cz.

We are not liable for any damage caused by acts or omissions of third parties or for actions that do not constitute a breach of these Terms. Furthermore, we are not liable for any harm arising from your own actions or omissions that are in breach of these Terms, nor for any damage caused by circumstances excluding liability for damages (force majeure).

IX. FINAL PROVISIONS

The provisions of these Terms form an integral part of the related documentation, especially the Visitor Rules and the Complaints Policy. The Terms are available in both Czech and English.

The contract with you is concluded in Czech or English. The contract, including these Terms, is archived in electronic form and therefore will not be accessible. However, you will always receive these Terms and a confirmation of the issuance of the festival accreditation with a summary by email. We recommend saving the confirmation and Terms. In the case of multiple language versions of these Terms, the Czech version shall prevail.

The contract and all relations arising from it, including matters of its formation and validity, are governed by the laws of the Czech Republic, excluding conflict of law rules. Any disputes shall be resolved by the competent courts of the Czech Republic. In the case of any international element or cross-border performance, the governing law between the parties shall be the law of the Czech Republic, and jurisdiction shall lie with Czech courts (all disputes shall be finally resolved by Czech courts).

All regular written correspondence with you will be delivered via email or through your user account. We will send correspondence to the email address provided in your user account or through which you contacted us.

The Organizer is only responsible for its own content, i.e., content it has exclusively created, actively made available, or adopted as its own. The Organizer has the right to remove false, misleading, or difficult-to-verify information and data from the content of the user account, and the right to cancel registration or the use of any services in the event of a justified suspicion that you are knowingly violating these Terms or engaging in unlawful conduct. The Organizer bears no responsibility for any content you communicate via the platform or user account.

In the event of force majeure or unforeseeable events (natural disaster, pandemic, operational failures, subcontractor outages, etc.), we are not liable for damage caused as a result of or in connection with such force majeure events.

We are entitled to assign, in whole or in part, our rights and obligations arising from these Terms to any company within the KVIFF Group or to a legal successor without your prior consent. You are not entitled to assign any of your rights or obligations arising from these Terms, in whole or in part.

We may unilaterally amend these Terms from time to time. You will be notified of the new current version of the Terms by email we have on record. Notification of changes to the Terms will always be made at least one month before the changes take effect.

These Terms enter into force on April 1, 2025.
